The Ciudad Peronia Massacre case involves the murder of four individuals by members of the Guatemalan army on January 16, 1992. The accused, Nicolás Gutiérrez Cruz and Eliseo Suchite Hernández, were charged with the premeditated murder of Juan Xam, Juan Calel Grave, Francisco Jax López, and Marvin Alexander Xam Santizo. The court found that the accused, while under the influence of alcohol and without any justification, used their military firearms to murder Juan Xam, Juan Calel Grave, Francisco Jax López, and Marvin Alexander Xam Santizo (a minor) or Barbaro Lizandro Xam Santizo in a local store in Ciudad Peronia, Municipality of Villa Nueva, Department of Guatemala. The accused, members of the Guardia de Honor Military Brigade stationed at the Finca La Selva Military Base, left their post with their military weapons and went to the store "La Mazateca," located in the El Gran Mirador Settlement of Ciudad Peronia. There, they used their M16 rifles with attached grenade launchers to shoot and kill the victims. The murders were characterized by brutality, abuse of authority, and premeditation. The court heard testimonies from eyewitnesses, forensic reports, and expert testimonies that corroborated the sequence of events and the involvement of the accused. The evidence presented included ballistic reports that matched the bullets recovered from the victims' bodies to the firearms issued to the accused. The court concluded that the actions of Nicolás Gutiérrez Cruz and Eliseo Suchite Hernández were deliberate and constituted a grave violation of human rights and an abuse of military power. The Military Tribunal issued its sentence on February 25, 1992, considering the nature and severity of the crimes, the premeditation and malice with which the murders were carried out, as well as the impact on the community and the victims' families. Consequently, the accused were sentenced to 30 years of imprisonment without the possibility of parole for each of the four murders. Additionally, they were ordered to pay an indemnity of four thousand quetzals to the legal heirs of the victims. On appeal, the defense argued that there were inconsistencies in the testimonies and that the accused's actions were not intentional. However, the court of appeals upheld the original convictions, emphasizing the overwhelming evidence and the gravity of the crimes committed. The Court of Appeals imposed the death penalty for each accused, highlighting the need for accountability and justice for the victims and their families. This is a controversial ruling because it reinstated the imposition of the death penalty after ten years. For this reason, later on, he was resentenced to 30 years in prison.

We hope that this collection will be an important resource not only to researchers, but also to the Guatemalan people, providing access to historical documents that otherwise would remain hidden away from public view, and if not preserved, gradually vanishing.
